Hanover (ddp). The State Chancellery in Hanover signals possible derogation from the previous line in the disputed regulation for the protection of non-smoking in restaurants. In Lower Saxony Prime Minister Christian Wulff and Minister of Social Affairs Mechthild Ross-Luttmann (both CDU) be agreed next week to discuss alternatives to the legal requirements to protect against passive smoking in the catering sector, said a spokesman of the State Chancellery on Tuesday in Hanover. There have always existed agreement about a consistent ban on smoking in the catering sector. Will currently wrestled to the track for reasonable exceptions, the spokesman stressed. Basically this is a certain sympathy for liberal solutions, a vote with their feet and the reliance on the mature citizens. Lower Saxony will pass a law for the comprehensive protection against secondhand smoke to 1 July. It will contain although strict smoking bans, for example, for nightclubs, schools as well as regional and local authorities. To be exempted according to current plans however the hosts, specifically designate their homes as smoking restaurant. It had from the outset were agreement that the result of the hearing, in which the Bill is currently, could lead to changes, the spokesman said. This applies in particular if it should emerge that on independent decision the desired non-smoker protection in the restaurant industry not could be guaranteed. Prime Minister Wulff was into criticism on the weekend due to the exceptions in the protection of non-smoking. Because the cigarette industry had sponsored events of the country, the opposition had accused him of venality. A charge of non-smoking Association Pro smoke against Prime Minister Wulff is, however, in vain. The Hanover Prosecutor’s Office refused on Wednesday to launch a preliminary investigation against the head of Government. A legal analysis of the criminal complaint have shown that actual evidence for the existence of a crime do not exist, said prosecutor Thomas blade.
